celebritiesSinger Katy Perry, 38, has lost a trademark lawsuit against an Australian fashion brand that bears nearly the same name as her. Katy Perry sued her near name over merchandise the singer sold during her Australian tours in 2014 and 2018. The judge ruled in favor of the fashion designer.
Katy Taylor, who sells her clothes under her maiden name Katy Perry, sued in 2019, alleging that the singer used her trademark, selling Christmas cardigans, sweaters, T-shirts, sweatpants and scarves under cover retailers and websites during her tenure. Concert tours across the country through retailers and websites selling the name “Katy Perry”. Although she did so “in good faith,” according to the judge, it still infringed Katie’s Australian copyright and trademark. Compensation will be determined later.
Katie sees her victory in court as a “David v. Goliath” case, she writes its website. Not only did I fight for myself, but I also fought for other small businesses in this country. “Many of them are founded by women who have to compete against offshore companies that have far more financial power than we do,” Katie writes.
The process was difficult for her. “In recent years I have been bullied and harassed. I had to put up with disparaging remarks made about me while I sat in court with tears in my eyes. I was told I was naive and pushy – but those are just the traits of entrepreneurs trying to start a startup.”
They were at odds with each other for a long time
The battle between the pop star and the Australian fashion designer over their similar name began in 2008 when Taylor registered the trademark “Katy Perry” in Australia. The singer, who recorded her first hit that same year, first tried to block the recording and then hired lawyers to force the designer to stop using the name. Later I gave it up.
The singer’s management has not yet responded, according to “AD”.
